1. Introduction

These Terms of Service ("Terms") govern your use of the Movimiento website and services. By accessing our website or submitting an enquiry, you agree to be bound by these Terms. If you do not agree, please do not use our services.

Movimiento is operated by Evangelia Karletsou, a sole trader based in the United Kingdom, trading as Movimiento.

2. Who May Use Our Services

Our services are available to individuals who are:

• Aged 18 or over
• Based anywhere in the world (online delivery)
• Physically capable of participating in fitness activity, or doing so under medical supervision where appropriate

By submitting an enquiry or participating in any Movimiento programme, you confirm that you meet these eligibility requirements.

3. The 3-Day Free Trial

Movimiento offers a 3-day free online fitness trial ("the Trial") to new enquiries. The Trial is subject to the following conditions:

• The Trial is available to new clients only. One Trial per person, per email address and phone number.
• Participation is subject to completion of the enquiry form including the Physical Activity Readiness Questionnaire (PAR-Q). Movimiento reserves the right to decline participation where PAR-Q responses indicate a health or safety concern.
• Movimiento reserves the right to decline participation at its discretion.
• The Trial includes access to online fitness sessions via Zoom, as communicated via email following your enquiry. Details of format, schedule, and delivery will be confirmed at the time of acceptance.
• The Trial is provided free of charge. No payment is required to participate.
• There is no automatic conversion to a paid programme at the end of the Trial. Any continuation of services is subject to a separate agreement between you and Movimiento.

4. Paid Services

Following the Trial, if you choose to continue with Movimiento's coaching services, the following applies:

• Pricing, payment terms, and programme details will be agreed directly between you and Evangelia Karletsou prior to commencing paid services.
• Payment is made directly to Movimiento via bank transfer or such other method as agreed.
• Movimiento does not process card payments through its website. No payment data is collected or stored on our platform.
• Cancellation, refund, and rescheduling policies for paid programmes will be set out in a separate service agreement at the time of engagement.

Terms applicable to each specific service or programme will be communicated and agreed separately at the time of engagement.

5. Health and Safety Disclaimer

Read this section carefully.

Participation in any fitness programme carries inherent risk. By using Movimiento's services, you acknowledge and agree to the following:

• Completion of the PAR-Q health screening questionnaire is a condition of participation. You must answer all questions honestly and completely before your Trial begins.
• If you answered yes to any PAR-Q question, you may be required to seek medical clearance before participating. Movimiento reserves the right to defer or decline your participation until such clearance is provided.
• You have disclosed all relevant health conditions, injuries, and physical limitations in your enquiry form and to Evangelia Karletsou directly.
• You accept full responsibility for your own health and wellbeing during participation.
• If you have any pre-existing medical conditions, you should consult a qualified medical professional before beginning any fitness programme.
• Evangelia Karletsou holds a Level 3 Personal Training qualification and delivers Movimiento's services within the scope of that qualification. Movimiento provides fitness coaching and educational guidance only. Nothing provided through the services constitutes medical, healthcare, therapeutic, diagnostic, or other regulated professional advice, and clients should seek advice from an appropriately qualified professional where necessary.
• You agree to stop exercising immediately and seek medical attention if you experience pain, dizziness, shortness of breath, or any other adverse symptoms.
• Evangelia Karletsou holds public liability and professional indemnity insurance in connection with the delivery of Movimiento's services. This insurance does not limit or replace your right to seek independent legal or medical advice, and does not affect any statutory rights you may have under applicable law.

6. Force Majeure

Movimiento shall not be liable for any failure or delay in delivering sessions or services where such failure or delay results from circumstances beyond its reasonable control, including but not limited to illness, injury, technical failure, internet outages, or other events outside Movimiento's reasonable control. In such cases, Movimiento will make reasonable efforts to reschedule or communicate with affected clients promptly.

7. Online Session Conduct

For online sessions delivered via video (Zoom or equivalent):

• You are responsible for ensuring your training environment is safe, clear of hazards, and appropriate for physical activity.
• Sessions are for your personal use only. Recording, redistribution, or commercial use of any session content is strictly prohibited. You may not copy, reproduce, or share any materials, exercises, programme content, or session recordings provided by Movimiento without prior written consent.
• Movimiento reserves the right to end a session if conduct is inappropriate or if a safety concern is identified.

8. Intellectual Property

All content on the Movimiento website — including text, design, graphics, training materials, and programme content — is the intellectual property of Movimiento and Evangelia Karletsou unless otherwise stated.

You may not reproduce, distribute, modify, or use any content for commercial purposes without prior written consent from Movimiento.

9. Website Use

You agree to use the Movimiento website only for lawful purposes. You must not:

• Submit false or misleading information in the enquiry form
• Attempt to gain unauthorised access to our systems
• Use the website in any way that disrupts, damages, or impairs its functionality
• Engage in any conduct that is harmful, offensive, or violates the rights of others

10. Limitation of Liability

To the fullest extent permitted by law:

• Movimiento's total liability to you in connection with our services shall not exceed the total amount paid by you to Movimiento in the 12 months preceding the event giving rise to the claim.
• Movimiento is not liable for any indirect, consequential, or incidental losses, including loss of income or opportunity.
• Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot lawfully be excluded under UK law.

11. Privacy

Your use of our website and submission of personal data is governed by our Privacy Policy, which forms part of these Terms. Please read it carefully. It is available at https://movimiento.uk/privacy-policy.html.

12. Governing Law

These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction to settle any such dispute or claim.

13. Changes to These Terms

Movimiento may amend these Terms at any time. The updated Terms will be published on the website with a revised "Last updated" date. For minor or administrative changes, your continued use of the website or services after any changes are made constitutes acceptance of the updated Terms. For any material changes — including changes that affect how your personal data is used, your rights, or the scope of our services — existing clients will be notified directly before those changes take effect.

14. Severability

If any provision of these Terms is found to be unlawful or unenforceable, that provision will be severed from the remaining Terms, which will continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Movimiento regarding your use of our website and services. They supersede all prior agreements, representations, or understandings.
